Terms and Conditions

Unless an alternative supply agreement is in place between Markon and the Customer with variations to the conditions below, and is signed and dated by both parties and is within the current valid agreement dates, then the following terms and conditions will apply.

PRICING

For pricing, see separate price sheet. Prices are subject to change without prior notice. Prices on Markon price lists are those, which are in effect as of the date of publication and are only fixed for the time mentioned in our offer. Invoices will reflect the prices in effect upon the date of receipt of order. If in doubt, contact Markon for current pricing prior to order placement.

TERMS / PAYMENT

Payment shall be made within the date specified in the invoice. Where such date is not stated, we reserve the right to supply only against a prepayment or payment shall be made cash on delivery. All payments are to be in the currency stated. Terms are issued upon approval.

TAXES

Prices do not include sales, use, license, excise or other taxes with respect to the manufacturer, sales, delivery, and export duties of the goods, all of which are the sole responsibility of the customer.

SHIPMENT AND DELIVERY

Unless otherwise stated and agreed the goods are shipped ex-works. Shipping and delivery dates are given as estimates only, based on factors in existence at the time such estimates are made. Each delivery will be deemed to be a separate sale, and the customer will make payment on partial deliveries. Markon will not be liable for damages due to delays in, or the inability to complete the manufacture and delivery of goods due to labour difficulties, weather, acts of GOD, government acts or regulations, shipping delays, inability to obtain equipment or materials from source of supply, or any other cause whatsoever beyond reasonable control of Markon. Markon does not accept requirements for compensation from delays.

DAMAGES AND RISK OF LOSS

All damages or risk of loss and all incidents of title and ownership will pass to the customer upon Markon’s delivery of the goods to the carrier (FOB shipping point), even if Markon may have selected the carrier. In no event will Markon be liable for any loss or damage, including but not limited to loss of profits, incidental or consequential damages, that result after Markon delivers the goods to the carrier or during shipment of the goods. For any such loss or damage, Markon will have no responsibility whatsoever, and the customer will be responsible for initiating and processing all claims directly with the carrier
